Out There Entertainments – Artist & Band Membership Agreement

(Non-Contractual Working Agreement for Platform Use)

This Artist & Band Membership Agreement (“Agreement”) outlines how Out There Entertainments (“we”, “us”, “our”, “OTE”) works with performers, musicians, entertainers, DJs, and bands (“you”, “your”, “the Artist”) who join our membership platform (“Membership”).

This is not a legally binding contract.
It is a mutual working agreement designed to make sure we are all clear, happy, and working in the same direction.

By purchasing or using a Membership, you confirm you understand and agree to everything stated in this Agreement.


1. Purpose of the Membership

The Out There Entertainments Membership exists to:

  • Promote and showcase local entertainers across the region
  • Provide structured promotional and marketing support
  • Offer visibility through our website, social media, and wider network
  • Create opportunities for paid bookings and public exposure
  • Provide discounted services, creative support, and professional tools
  • Build a community where both OTE and artists benefit through shared promotion

This platform works as a two-way partnership:

  • The more you engage, promote your OTE membership, and keep your content updated, the more we can promote you in return.
  • OTE is here to enhance your career, but you must actively want to grow and participate for the platform to work.

2. Membership Tiers & What They Include

Below is a full breakdown of the current membership tiers. These inclusions may be refined or expanded over time to improve the service.

2.1 Tier 1 – Promotional Membership (£9.99/mo or Annual Equivalent)

Designed for emerging artists who want an affordable way to gain visibility.

Includes:

  • Artist Profile on OTE Website
  • Directory Listing on OTE Website
  • Ability to receive booking enquiries
  • Promotional posts
  • Access to discounted studio time (Regional)
  • Access to member-only email updates and opportunities
  • Access to merch printing at member rates

2.2 Tier 2 – Musical Membership (£19.99/mo or Annual Equivalent)

A boosted tier for artists who want more consistent promotion and stronger exposure.

Includes everything in Tier 1, plus:

  • Priority placement in artist search listings
  • Regular promotional features across our digital channels
  • Priority consideration for paid gig opportunities
  • Creative services discounts (photo/video/graphic design)
  • Social media shout-outs during relevant periods
  • Access to partner discounts and collaborations
  • Permission to submit news, updates and releases for potential feature
  • First-access to event performance slots

2.3 Tier 3 – All-In Elite Membership (£29.99/mo or Annual Equivalent)

Our highest level of support, designed for serious performers wanting maximum exposure.

Includes everything in Tier 1 & 2, plus:

  • Featured “Elite” positioning on the website
  • Regular scheduled promotional campaigns
  • Quarterly personalised marketing guidance
  • Priority gig and event recommendations
  • Priority booking management through OTE
  • Access to premium photo/video shoot discounts
  • Profile review and optimisation support
  • Increased content sharing across OTE’s networks
  • Exclusive access to partnership and sponsorship opportunities


2.4 Key Membership Benefits – What Each Area Covers

Regardless of tier (with higher tiers generally receiving more or priority exposure), your Membership may include the following types of benefits:

Artist Profile on the OTE Website

Your dedicated artist profile acts as your central showcase and typically includes:

  • Your bio
  • Music demos (SoundCloud/Spotify/YouTube, etc.)
  • Photo gallery
  • Genre, location & performance styles
  • Social media links

Your profile is designed to visually reflect your brand, highlight your personality, and help potential clients understand exactly what you offer.

Directory Listing

Your act appears in our public Artist Directory, where users can browse and filter by:

  • Genre
  • Location
  • Style
  • Event type and more

Directory listings give you passive visibility whenever someone searches for entertainment in your category. Higher tiers may receive priority placement.

Gig Opportunities & Recommendations

We regularly receive enquiries for events, parties, weddings, corporate bookings and more. As a member you gain:

  • Eligibility for paid gig referrals
  • Priority consideration (higher tiers receive more priority)
  • Invitations to relevant events or short-notice opportunities
  • Internal recommendations to clients based on style, location and availability

OTE can recommend you – but the actual performance, behaviour and delivery of the gig are your responsibility.

Promotional Campaigns

You may be included in curated promotional pushes such as:

  • Seasonal campaigns (Christmas, summer, Halloween, etc.)
  • “Featured Act of the Month” slots
  • Local talent highlight series
  • Website homepage features

These campaigns are designed to expand your reach and get you in front of new audiences.

Social Media Features

Our social channels help you get seen by:

  • Potential bookers
  • Local venues and event organisers
  • The wider public and creative community

Features can include:

  • Posts & reels
  • Stories and shout-outs
  • Highlight posts for new members, releases or events

Higher tiers receive more frequent and priority social promotion.

Creative Service Discounts

Members receive reduced rates on:

  • Professional photo shoots
  • Promo and gig highlight videos
  • Graphic design (logos, posters, social assets)
  • Showreel editing
  • Branding and promo packages

These services help elevate your professional look and make your act more bookable.

Merchandise Opportunities

Membership can unlock:

  • Branded apparel and accessories
  • Stickers, posters and other print items
  • On-demand printing via approved partners
  • OTE collaborative merch opportunities
  • Member pricing for larger orders

This supports artists who want to develop additional revenue streams and brand presence.

Access to Partners & Sponsors

We work with regional partners and sponsors. As a member, you may gain:

  • Access to exclusive offers
  • Discounts from partner studios or suppliers
  • Invitations to collaborative events
  • Opportunities to appear at partner showcases

This network expands your opportunities beyond just the OTE platform.

Priority Studio Time & Discounted Rates

Through our own or partner facilities, you may receive:

  • Discounted rehearsal or recording time
  • Priority booking of peak times
  • Early access to special sessions or packages

This helps you develop your sound and show in a professional environment.

Event / Booking Management Services

For suitable gigs and tiers, OTE may:

  • Receive and handle the initial enquiry from a client
  • Ask you for a quote based on the event details
  • Package and present that quote (plus our commission) back to the client
  • Confirm the event details with you when a client proceeds

OTE helps manage the front-end of the booking process, but is not your legal representative or agent.

Enhanced Marketing Support

For artists on higher tiers, we may provide:

  • Profile and content optimisation suggestions
  • Advice on branding, socials and demos
  • Guidance on how to present your act to increase bookings
  • Periodic marketing check-ins or reviews

This support is focused on helping you look and sound as professional as possible.

 

3. Membership Term, Payment & Renewal

  • Memberships are billed annually, unless clearly stated otherwise.
  • All payments are processed securely through our payment provider.
  • Membership applies to a single artist/band or entertainer as named during registration.
  • Membership may automatically renew unless cancelled prior to the renewal date.
  • Because your profile and promotional services activate quickly after purchase, no refunds are provided once access begins.

4. How Bookings & Payments Work Through OTE

To keep things clear:

  1. Client Enquiry
    • A client submits an enquiry or booking request via the OTE website or directly via OTE.
  2. We Contact You for a Quote
    • OTE will contact you with the event details (date, time, location, duration, type of event, special requirements).
    • You provide a quote for your fee for that specific event.
  3. OTE Adds Commission
    • OTE adds a commission to your quote based on the services offered and our involvement.
    • The client sees the total price (your fee + OTE commission).
  4. Client Pays OTE
    • Where applicable, payments are made through OTE.
    • OTE collects payment from the client for the agreed total.
  5. Payment to the Artist
    • After the event (or in line with a payment schedule agreed with you), OTE pays you your agreed fee minus our commission.
  6. Your Responsibility Beyond the Booking
    • Once a booking is confirmed, everything that happens at or around the gig is your responsibility as the performing artist.
    • This includes: your conduct, performance quality, equipment, travel, set-up, pack-down, and adherence to any agreements with the client or venue.

OTE aims to make the process smooth for both the client and the artist, but we do not act as your legal representative and we do not control what happens during the performance itself.

 

5. Important: What OTE Does Not Guarantee

While OTE works hard to promote artists, you understand that:

  • We cannot guarantee bookings, income, performances, or specific results.
  • We are not a talent agency and do not act as legal representatives.
  • We do not negotiate legal performance contracts on your behalf.
  • We do not take responsibility for your conduct at gigs, rehearsals, or events.
  • We do not cover losses, damages, cancellations, or disputes with venues, clients, or event organisers.

All bookings beyond the initial introduction, quote, and payment handling are solely the responsibility of the artist.


6. Artist Responsibilities

To be part of the OTE platform, you agree to:

6.1 Provide Accurate, Updated Content

You must keep your profile updated with:

  • Current images, demos and videos
  • Accurate band/artist information
  • Realistic gig availability
  • Correct names, socials and branding
  • Honest representation of your act

6.2 Professional Conduct Requirements

When performing or representing OTE, you must:

  • Behave professionally, respectfully and reliably
  • Communicate clearly and promptly with enquiries
  • Arrive on time and complete agreed bookings
  • Treat venues, clients, audiences and OTE staff with respect
  • Avoid any behaviour that may reflect negatively on OTE

Any serious complaint or repeated issue about your behaviour, reliability or conduct may result in immediate removal from the platform without refund.

This includes (but is not limited to):

  • Abuse or rudeness towards clients, venues or staff
  • Failure to attend a confirmed booking (no-show)
  • Misrepresentation of your act or abilities
  • Offensive or inappropriate conduct online or offline
    Damage to venue property
  • Behaviour that risks the safety of others

You are representing both your brand and the OTE brand when booked through us.

6.3 Mutual Promotion Agreement

Because OTE invests in promoting you, you agree to:

  • Tag “Out There Entertainments” or use our handle in relevant posts
  • Share your OTE profile link where appropriate
  • Use the OTE digital badge on your socials or website
  • Credit OTE when using promotional media we create for you
  • Help promote the platform whenever realistically possible

This partnership is essential for the growth of both you and the wider OTE community.

 

7. OTE’s Responsibilities

We will:

  • Host your artist profile and ensure stable platform operation
  • Promote you according to your Membership tier
  • Provide professional branding, visibility and creative support
  • Communicate relevant opportunities that match your act
  • Handle general booking enquiries through the site
  • Present your act honestly and positively based on the information you provide
  • Maintain the integrity and reputation of the OTE community

8. Intellectual Property & Media Usage

By joining OTE, you grant permission for us to:

  • Display your supplied images, demos, videos, logos and text
  • Use your materials in promotional activity related to your membership
  • Share your profile and content across platforms for marketing purposes

All rights remain yours – this Agreement simply permits OTE to use your materials for promotional purposes while you are a member.

If you leave OTE, you may request removal of your materials at any time, and we will action this within a reasonable timeframe.

 

9. Cancellations, Termination & Suspension

9.1 You May Cancel Anytime Before Renewal

  • Cancelling stops your next renewal but does not refund the current term.
  • Your profile and membership benefits will remain active until the end of the paid period.

9.2 OTE May Suspend or Remove a Member If:

  • You breach this Agreement
  • You behave unprofessionally or disrespectfully
  • You act in a way that harms OTE’s reputation
  • You receive substantiated complaints from clients or venues
  • You misuse the OTE brand
  • You upload inappropriate, offensive or illegal content

No refunds are given for termination due to misconduct, complaints or breach of this Agreement.

 

10. Liability Statement

Because OTE is a promotional and booking platform, not an employment agency, you acknowledge that:

  • All bookings, performance agreements and conduct at events are strictly between you and the client.
  • You are fully responsible for your equipment, travel, safety, behaviour and performance.
  • OTE is not liable for cancellations, disputes, damages, accidents, losses or injuries arising from your performances.
  • You perform entirely at your own risk.

11. Governing Approach

Because this is not a legal contract, formal court jurisdiction is not specified.
However, in the event of any dispute, both parties agree to:

  • Communicate in good faith
  • Share information honestly
  • Aim to resolve matters fairly and amicably

13. Complete Agreement

This document forms the entire working agreement between you and Out There Entertainments.

By joining or maintaining your membership, you confirm that:

  • You have read and understood this Agreement
  • You accept the tier benefits and responsibilities
  • You understand this is a mutual partnership, not a legal contract
  • You acknowledge the behavioural expectations and platform rules
  • You understand that bookings are processed through OTE, but the gig itself is your responsibility
  • You understand OTE adds commission to your quote when offering prices to clients
  • You agree that serious misconduct, disrespectful behaviour or substantiated complaints may result in removal from the platform without refund

 

To keep things simple and avoid any issues with promotion timetabling or gig bookings, our Artist Membership is billed annually. This ensures consistency for you and makes it easier for us to plan your promotions, events, and opportunities throughout the year. Each application is limited to one package and applies to a single artist or band only.
