These Website Terms & Conditions (“Terms”) govern your use of the Out There Entertainments website (“Website”, “Platform”) and all services, memberships, bookings, digital products and content provided by Out There Entertainments (“we”, “us”, “our”, “OTE”). By accessing or using the Website, purchasing a Membership, submitting a booking enquiry, or engaging with any part of the Platform, you agree to be bound by these Terms in full.

If you do not agree, you should not use this Website.

1. About Out There Entertainments

OTE is a platform that provides artist and band memberships, promotional and creative support services, a public entertainment directory, a booking enquiry and commission-based facilitation system, and digital products, promotional packages and marketing tools.

OTE is not a talent agency and does not act as a legal representative for any artist. All artists, performers, musicians and entertainers listed on the platform act as independent individuals, not employees of OTE.

2. Website Use & User Conduct

You agree not to use the Website for illegal purposes, uploading or sharing offensive, defamatory, harmful or infringing content, attempting to disrupt or damage the Website, misrepresenting yourself or your act, harassing users, staff, artists or clients, or attempting to hack, scrape or exploit system data.

We reserve the right to block or terminate access for any user who breaches these rules.

3. Artist Memberships & Digital Purchases

Purchasing a Membership gives artists access to the OTE platform and promotional tools. By purchasing a Membership, you acknowledge this is not a legal contract but a mutual working agreement, you gain immediate access to digital and promotional services, and the standard 14-day cooling-off period does not apply once digital access is granted.

Membership fees are non-refundable. Memberships renew automatically unless cancelled before renewal. You must provide accurate information and keep your profile updated.

Membership does not guarantee bookings. OTE may update or change membership features at any time. OTE is not responsible for the artist’s behaviour, equipment, travel or performance quality.

4. How Bookings Through the Website Work

When a client submits a booking enquiry, OTE receives the enquiry, contacts the artist for availability and a quote, and the artist provides their fee. OTE adds a commission and presents the total price to the client. The client may pay OTE for the booking. After the event takes place, OTE pays the artist their agreed fee minus OTE commission.

Artists agree that all responsibility at the event sits entirely with them. They must act professionally, honour bookings, and deliver their services safely and respectfully. Misconduct may result in termination without refund. OTE is not liable for anything that happens at the event or gig.

5. Behaviour & Complaints

Artists represent both themselves and OTE when listed on the platform. Professional, respectful behaviour is required at all times. No harassment, rudeness, offensive conduct, misrepresentation or no-shows are tolerated.

If OTE receives a substantiated complaint, we may issue a warning, suspend the profile or permanently remove the artist from the platform without refund. Complaints may come from venues, clients, event organisers or OTE staff.

6. Payments, Pricing & Commission

Clients agree that payments processed through the Website are secure and that prices shown include the artist fee plus OTE commission. Payments are non-refundable unless required by law.

Artists agree that OTE adds commission to their quoted fee, that commission rates may vary and that OTE is not responsible for late client payments (although we assist in communication).

7. Intellectual Property

All content on the Website, including logos, text, images, artwork and layouts, is owned by OTE unless otherwise stated.

Artists grant OTE permission to use their submitted images, audio, video, logos and promotional materials for profiles, social media, marketing campaigns, bookings and platform promotion. All artistic rights remain with the creator. Artists may request removal of materials upon ending their membership.

Clients may not download or republish artist content without permission.

8. Privacy, Data & GDPR

By using the Website, you agree to OTE’s Privacy Policy and GDPR-compliant data handling practices. We collect and process data for memberships, bookings, payments, communication and promotional purposes.

We do not share personal data with third parties except payment processors, email service providers, marketing platforms (with consent) or legal authorities when required. Users may request deletion, correction or export of their data at any time.

9. Liability & Disclaimers

OTE is not responsible for damages, losses, injuries or issues arising from bookings, performances, events or user interactions. OTE does not guarantee bookings or performance outcomes for artists. Users access the Website at their own risk.

Artists perform at events entirely at their own risk. Clients book artists entirely at their own risk. OTE is not liable for event cancellations, disputes, accidents, equipment failure, travel delays, property damage, illness or loss of income.

OTE’s total liability is limited to the value of the product or service purchased.

10. Termination of Access

OTE may suspend or terminate any user account or membership if these Terms are breached, false information is provided, payments fail, misconduct occurs or the platform is misused. Termination due to misconduct is non-refundable.

11. Third-Party Links

The Website may include links to third-party sites, sponsors or partners. OTE is not responsible for their content, policies or services. Users visit third-party sites at their own risk.

12. Changes to Terms

We may update or revise these Terms at any time. Continued use of the Website indicates acceptance of updated Terms. Users should check this page regularly for changes.

13. Governing Law

These Terms are governed by the laws of England & Wales. Any disputes should be handled professionally and in good faith, and if necessary, through the courts of England & Wales.
