This Refund Policy (“Policy”) describes how refunds are handled for all Memberships, bookings, payments, digital services, merchandise and promotional products purchased through the Out There Entertainments website (“Website”, “Platform”). By purchasing from Out There Entertainments (“we”, “us”, “our”, “OTE”), you agree to this Policy in full. This Policy has been created to reflect how our Membership system works, how bookings are processed, and how our digital and promotional services are delivered.

1. Membership Refunds

All Out There Entertainments Memberships are digital and promotional services that activate immediately upon purchase. This includes artist profile creation and hosting, directory listing, access to booking enquiries, promotional visibility, support services, member perks, discounts, partner benefits and priority placement where applicable. Because Membership benefits begin straight away, all Membership payments are strictly non-refundable, including (but not limited to): change of mind, no longer performing, not receiving bookings, dissatisfaction with exposure levels, lack of engagement with the platform, forgetting to cancel before renewal, leaving the entertainment industry, moving location, rebranding, personal circumstances, accidental purchase, technical issues outside OTE control, account misuse or removal due to misconduct. The standard UK 14-day cooling-off period does not apply once digital services have begun.

2. Immediate Activation & Digital Goods

When you purchase a Membership, access is granted instantly. Your profile space is created, promotional systems activate and you enter the OTE ecosystem immediately. Therefore, the service is considered delivered from the moment you pay. For this reason, Membership fees cannot be cancelled, refunded or partially refunded.

3. Automatic Renewals

Some Memberships renew automatically. Refunds are not available for renewal charges, forgetting to cancel, not receiving reminder notifications or unused time after renewal. You are responsible for cancelling your Membership before the renewal date.

4. Removal Due to Misconduct, Complaints or Breach

If an artist is removed from the platform because of unprofessional behaviour, no-shows, rudeness, disrespect, offensive behaviour, client complaints, venue complaints, misrepresentation of their act, harmful conduct, damaging the OTE brand, breaching the Membership Agreement or misusing the platform, no refund will be provided regardless of how much time remains. Suspensions and removals are final.

5. Booking Payments (Clients)

When clients book an artist through OTE, payments are processed securely. Bookings are confirmed once paid. Payments are passed on to the artist after the event minus OTE commission. Client payments are non-refundable once confirmed unless required by law. This includes changes of mind, cancellations, poor attendance, weather issues, venue problems or agreed artist substitutions. The agreement for a performance and any refund is between the artist and the client, not OTE.

6. Artist Cancellations (for Bookings)

If an artist cancels a confirmed gig, OTE may remove the artist from the platform. No Membership refund will be given. The artist may be responsible for compensating the client. The client’s refund, if any, must be handled directly between the artist and the client. OTE is not responsible for disputes regarding cancellations.

7. Client Cancellations (for Bookings)

If a client cancels an event, OTE does not guarantee refunds. The refund terms are set by the artist, not OTE. The artist may offer a full refund, partial refund or no refund at their own discretion. OTE can help relay messages but does not enforce policies.

8. Digital & Creative Services Refunds

Refunds are not available for promo videos, photoshoots, design work, social media campaigns, marketing packages, showreels, advertisements or any creative services. Time, labour and preparation begin before delivery. If a customer fails to supply required information, delays caused by missing materials do not qualify for refunds.

9. Merchandise Refunds

Refunds are not available for custom printed merchandise, artist-branded items, made-to-order products, incorrect sizes provided by the customer or change of mind. Refunds may be issued if items arrive damaged, misprinted or incorrect. Customers must notify OTE within 7 days of delivery.

10. Duplicate Charges & Billing Errors

Refunds may be granted if you were charged twice, charged incorrectly or billed for a product you did not receive. Contact us immediately so we can investigate.

11. Chargebacks

Submitting a chargeback without contacting OTE first may result in immediate membership termination, permanent removal from the platform, loss of your artist profile, loss of promotional content and removal of booking eligibility. We always resolve legitimate billing issues.

12. System Failures, Website Downtime & Technical Issues

Refunds are not given for temporary website downtime, directory visibility issues, search ranking changes, reduced traffic, social media performance variation or problems caused by third-party platforms. OTE will always work to resolve issues but cannot compensate for temporary interruptions.

13. Event Disruptions & Emergencies

OTE is not responsible for disruptions including weather issues, venue cancellations, emergency closures, illness, transport problems, technical failures, noise complaints, power failures or any unforeseen event. These matters are strictly between the client and the artist.

14. Disputes Between Artists & Clients

OTE is a facilitator, not a legal party to the performance agreement. If an artist and client disagree about refunds, performance quality, arrival times, set duration, technical requirements, behaviour, payments or expectations, they must resolve the matter directly. OTE may mediate but cannot enforce outcomes.

16. Acceptance of This Policy

By using the Website, purchasing a Membership, commissioning creative services or booking an artist through OTE, you confirm that you have read, understood and accepted this Refund Policy. All purchases are final, all Memberships are non-refundable, and all booking payments are handled according to this Policy.
